Canadian Art Sales Index Online Edition:

These Terms & Conditions below govern the Subscriber's use of the database provided by Westbridge Publications Ltd. and known as the Canadian Art Sales Index Online Edition (CASIOE). By using the Canadian Art Sales Index Online Edition the Subscriber agrees to, and is subject to, the terms and conditions of this agreement as stated below. The Subscriber acknowledges and agrees that it has no right, permission or authorization to use the Canadian Art Sales Index Online Edition other than in accordance with the following terms and conditions.

Terms & Conditions:

1. This subscription is for 1 user and is effective on the commencement date of the subscription and will continue for the term selected by the Subscriber and gives, under normal terms of use, unlimited access to the following data banks:

- Canadian art auction results recorded by the Canadian Art Sales Index from 2000 to the present

2. The term may be renewed, or a new term entered into, subject to the payment of the appropriate fees.

3. Either party may terminate this agreement at any time effective upon receipt of written notice by the other party or if one party fails to abide by any part of this agreement. The Subscriber may terminate the agreement by choosing not to renew their subscription upon expiration. No refund will be provided if the agreement is terminated by the Subscriber prior to the expiration of the term.

4. The Subscriber is permitted an unlimited access to CASIOE and Westbridge Publications Ltd. reserves the right to suspend this access in case of unusual usage such as automatic searches aiming at comparisons, control, storage or piracy of data.

5. Where images are available within the listings database the user undertakes, by subscribing to this service, not to reproduce, store or change the reproductions of works viewed using whatever medium and to whatever end.

6. Comments and notes written on this website by employees of, or for, Westbridge Publications Ltd. are protected by copyright. Westbridge Publications Ltd. reserves the right to prosecute any violator of rights applying to the protection of its data and image banks.

7. Except where authorised, any use of works other than for reproduction and private and individual consultation is forbidden. If you wish to publish or distribute information or images specific to this website you must first obtain agreement and consent from Westbridge Publications Ltd. at which time a reproduction or special-usage fee might be applicable.

8. Access to the database is limited solely to the Subscriber and is not transferable, and does not extend to any other person, employer, subsidiary or parent organizations. Westbridge Publications Ltd. grants the Subscriber a user name and password with which to access the database. Title and ownership of the database and information from the database remain vested with Westbridge Publications Ltd. and or third parties as the case may be, it is not transferred to the Subscriber.

9. When ordering on our website all prices are shown in Canadian dollars. CASIOE is not responsible for any difference that may arise between the estimated amount of your order and the invoiced amount, due to changing currency rates and bank fees.

Subscribers requiring technical or other support for CASIOE should call 604-736-1014 or email info@westbridgepublications.com. Westbridge Publications Ltd. agrees to provide reasonable assistance, however is not responsible if the Subscriber cannot access the licensed information via the network due to software incompatibilities or network issues on the Subscriber's end.

Disclaimer:

Westbridge Publications provides no warranty in respect to any aspect of this service; including, but not limited to merchantability, quality, accuracy or omissions.

If the Subscriber notices an inaccuracy of any information they may notify Westbridge Publications who in turn will make all possible and reasonable efforts to correct the error but are not liable to do so.

Westbridge Publications Ltd.'s failure to perform any of the terms of condition of this agreement as a result of conditions beyond its control such as power failures, network difficulties, Acts of God, and others, shall not be deemed a breach of this agreement.

Liablity:

Liability of Westbridge Publications Ltd. in respect of any and all claims arising out of, or in connection with, this agreement is limited in respect of each event or series of connected events to the amount of fees paid by the Subscriber under this agreement. This agreement and the rights and liabilities of the parties with respect to this agreement and the subject matter thereto, shall be governed by and construed according to the laws of the Province of British Columbia and the federal laws of Canada, as applicable in the circumstances.
